DESIGN FOR 99 TERMS & CONDITIONS

The following terms and conditions apply to all website development and hosting services offered by Design For 99. Accepting a quote, either verbally or in writing, shall be deemed as a contractual agreement between the Client and Design For 99.
These terms have been drawn up principally to protect Design For 99 from bad debts and the compensation culture – I am generally agreeable, understanding and flexible, and will be unlikely to strictly enforce these Terms & Conditions with clients that are also honest, agreeable, understanding and flexible.

Terms of service:
Having received a brief of requirements from The Client, either verbal or written, Design For 99 will produce a quotation detailing the work to be carried out. The Client must provide written confirmation that the quotation is acceptable by signing and returning a copy of the quotation with the required deposit. This will effectively form the basis of the contract.

Design For 99 will produce and publish, temporarily, on our website a design proof for The Client's approval. Acceptance of the website, or notice of required changes, must be given to Design For 99 within 72 hrs.

Design For 99 will agree to set up a .co.uk domain name with host if required, but will not be held responsible for any changes made by the server.

The Client represents to Design For 99 an unconditional guarantee that all elements of text, graphics, photos, designs, trademarks, or other art work given to Design For 99 for inclusion in their Web pages, are owned by the Client, and are free to use without breach of copyright law, and the Client will not hold Design For 99 responsible for any lawsuit or other action arising from the use of such elements furnished by the Client. All material provided by Design For 99, will remain the property of Design For 99. Design For 99 owns copyright to the finished web design site produced. Design For 99 retains the right to display graphics and other web design elements as examples of their work in their respective portfolio. All web design projects will contain a link to the Design For 99 site.

Hosting, support and updating packages are renewable annually; invoices are provided approximately one month before the renewal date. The package start date is based on when the package or domain name was first registered and not when the web project goes live.

Whilst any payment due under the agreement remains outstanding, Design For 99 shall be entitled, at its sole and absolute discretion, to withhold provision of any goods or services it would otherwise be obliged to provide under the agreement. On completion of the site, and acceptance by the Client, payment will be expected within 14 days by cash or cheque. If by cheque, the site will not be released until clearance of funds. Failure to pay within the time specified will result in deletion of the site. During the lifetime of the website, any other outstanding fees for additional work undertaken, which have not been cleared with 14 days of an invoice being presented, may result in the website being taken offline, until such time as payment is received.

Design For 99 uses independent third parties for web hosting and other services described on this website. We cannot take responsibility for any faults or failures of service on the part of these third parties, but can assure our Clients of our continued support in the unlikely event of difficulties occurring.
